1. Definitions

In these Terms and Conditions:

  • "Service" refers to watch repair, maintenance, and related services provided by Duskmotor
  • "User," "You," or "Customer" refers to individuals or entities using our services
  • "We," "Us," or "Our" refers to Duskmotor and its representatives
  • "Timepiece" refers to watches, pocket watches, and similar mechanical items
  • "Agreement" refers to these Terms and Conditions

2. Acceptance of Terms

By submitting a timepiece for service, using our website, or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.

You must be at least 18 years of age to enter into this agreement. If you are under 18, a parent or guardian must consent to these terms on your behalf.

3. Service Description

3.1 General Services

We provide professional watch repair and maintenance services including, but not limited to, movement servicing, case restoration, component replacement, and timing regulation. Services are performed by qualified watchmakers using appropriate tools and techniques.

3.2 Service Process

  • Initial inspection and assessment of timepiece condition
  • Detailed estimate provided before work commences
  • Customer approval required for work to proceed
  • Regular communication during service period
  • Final testing and documentation upon completion

3.3 Service Availability

Services are available Tuesday through Saturday, 10:00 AM to 6:00 PM. Workshop is closed on Sundays and Mondays. Service availability may vary during public holidays.

4. Customer Responsibilities

4.1 Accurate Information

You agree to:

  • Provide accurate information about your timepiece and its service history
  • Disclose any known damage, previous repairs, or relevant history
  • Inform us of any sentimental or exceptional value
  • Provide valid contact information for service updates

4.2 Ownership Verification

You warrant that you are the rightful owner of the timepiece submitted for service or have proper authorization to act on the owner's behalf. We reserve the right to request proof of ownership.

4.3 Timely Pickup

Timepieces must be collected within 30 days of service completion notification. Extended storage beyond this period may incur storage fees. Unclaimed items after 90 days may be disposed of in accordance with Malaysian law.

5. Payment Terms

5.1 Pricing and Estimates

Service estimates are provided following initial inspection. Final costs may vary if additional work is required, which will be communicated and approved before proceeding. All prices are quoted in Malaysian Ringgit (MYR).

5.2 Payment Methods

We accept cash, bank transfer, and major credit cards. Payment is required upon collection of serviced timepiece.

5.3 Refund Policy

Refunds are considered on a case-by-case basis. If you are dissatisfied with service quality, please contact us within 14 days of collection. We will assess the issue and determine appropriate resolution, which may include re-service at no additional cost or partial refund.

6. Service Warranty

6.1 Warranty Coverage

Completed service work is warranted for 12 months from collection date. This warranty covers defects in workmanship and parts used during service. Warranty does not cover damage from misuse, accidents, or unauthorized repairs.

6.2 Warranty Limitations

The warranty does not cover:

  • Normal wear and tear of components
  • Damage from water exposure if timepiece is not water-resistant
  • Damage from magnetic fields, shock, or extreme temperatures
  • Parts or components not serviced during the warranty period
  • Cosmetic damage to case, crystal, or bracelet

6.3 Warranty Claims

To make a warranty claim, return the timepiece with original service documentation. We will assess the issue and perform necessary repairs under warranty terms at no charge if applicable.

7. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Duskmotor or its content suppliers and is protected by Malaysian and international copyright laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Liability and Disclaimers

8.1 Service Limitations

While we exercise care and skill in all services, watch repair involves inherent risks. We cannot offer absolute outcomes for every timepiece, particularly those with pre-existing damage or obsolete components.

8.2 Limitation of Liability

Our liability is limited to the value of the timepiece as declared at time of service submission, or the service fee paid, whichever is greater. We are not liable for consequential, indirect, or incidental damages including loss of use, sentimental value, or lost profits.

8.3 Insurance

Timepieces in our possession are covered by our professional insurance. For high-value items, we recommend customers maintain their own insurance coverage as our policy limits may not cover full replacement value.

9. Force Majeure

We are not liable for delays or failures in service delivery due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, parts shortages, or other force majeure events.

10. Termination

Either party may terminate the service agreement with written notice. If you withdraw a timepiece before service completion, you may be charged for work already performed and parts ordered. We reserve the right to refuse service at our discretion.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, we encourage you to contact us first to seek informal resolution. Many concerns can be addressed through direct communication.

11.2 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Penang, Malaysia.

11.3 Mediation

If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally.

12. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, together with any service agreement or estimate, constitute the entire agreement between you and Duskmotor.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Continued use of our services after changes constitutes acceptance of revised terms. For significant changes, we will provide notice via email or prominent website notification.
